TERMS AND CONDITIONS

1. Order Delivery

Delivery Scope:

NZURY by J. Pinto Leitão delivers orders within national territory (Portugal). Delivery may be carried out by our logistics services or, alternatively, the Client may choose to hire a transport company of their preference, assuming full responsibility for collection, transport, and any damages or losses that may occur during the process.

Delivery Deadlines:

All pieces are made to order, handcrafted, and personalized, with no stock available. The estimated delivery time will be communicated upon order confirmation and may vary depending on the product’s complexity, current production volume, and Client’s location.

Delivery Conditions:

Delivery will be made to the address provided by the Client, who is responsible for ensuring adequate access to the location (e.g., stairs, elevators, doors with compatible dimensions). If access is not possible, delivery will be made to the nearest accessible point.For large items or locations with limited access, special equipment such as cranes or lifting platforms may be required. In such cases, all associated costs will be the Client’s responsibility and must be budgeted and approved beforehand.

Delivery Costs:

Delivery costs are calculated based on the order’s volume, weight, and destination, and presented in the provided quotation.

Reception and Verification:

The Client must inspect the packaging and the item upon delivery. In case of visible damage, the Client must refuse delivery or record the issue on the transport document and contact NZURY within 48 hours from the delivery date.

Assembly:

Assembly will be carried out by the NZURY team and is included in the quoted price unless stated otherwise. However, the installation of suspended pieces (such as shelves, among others) is not included and must be performed by qualified professionals hired by the Client.

NZURY by J. Pinto Leitão undertakes to keep the Client informed about the status of the order throughout production and delivery.

2. Payments

Payment Terms:

To confirm the order, an initial payment of 50% of the total quoted amount is required as a deposit and to initiate production. The remaining amount must be settled before delivery, unless otherwise agreed in writing.

Payment Methods:

Payments may be made via bank transfer, debit/credit systems, or other methods made available and communicated by NZURY. Payment details will be provided upon order confirmation.

Invoicing:

All amounts in quotations and invoices include VAT at the applicable legal rate. The invoice will be issued after receiving the initial payment and sent by email. The final invoice will be issued after full payment of the order.

Late Payments:

Production and/or delivery may be suspended if the agreed payment is delayed. NZURY reserves the right to apply penalties or cancel the order if payment is not regularized within a reasonable timeframe.

Cancellations and Refunds:

Since all pieces are custom-made and personalized, cancellations and refunds are not accepted once production has begun. Additionally, the Client may not exercise the right of withdrawal, as the products are made according to personalized specifications, under Article 17, no. 1, point (c) of Decree-Law 24/2014.

3. Prices

Price Definition:

All prices refer to custom-made furniture pieces, based on personalized specifications provided by the Client. Values are defined through individual quotations considering materials, dimensions, finishes, production complexity, and additional services requested.

Quotation Validity:

Quotations are valid for 15 business days from the date of issue. After this period, they may be subject to updates, particularly if there are changes in raw material costs or associated services.

VAT Included:

Prices include VAT at the applicable rate unless stated otherwise. Any change in VAT rates will be reflected in the final order value.

Project Changes:

Any changes requested by the Client after quotation approval may result in price adjustments, which will be communicated and must be approved prior to continuing production.

4. Warranty

Warranty Coverage:

All pieces include a 2-year warranty under applicable Portuguese law.

Warranty Exclusions:

  • Damage caused by improper use: including scratches, cuts, stains, or negligence.
  • Natural wear: natural variations in solid wood, such as color changes, cracks, or structural movement, which are inherent characteristics of the material.
  • Exposure to extreme environmental conditions: such as sunlight, excessive humidity, or extreme temperatures.
  • Unauthorized alterations: cuts, drillings, or structural modifications.
  • Accidental damage: falls, impacts, or similar incidents.
  • Lack of proper maintenance: including incorrect cleaning or lack of protective treatments.
  • Improper assembly: when not performed by the NZURY team.

Warranty Activation:

To activate the warranty, the Client must contact NZURY in writing, providing proof of purchase and a detailed description of the issue, including photographs. If non-conformity is confirmed, NZURY will repair, replace, or take other appropriate action.

NZURY’s liability is limited to the value of the purchased piece and does not cover indirect damages, loss of use, or other consequential losses.

5. Liability

Limitation of Liability:

NZURY is not liable for indirect, incidental, or consequential damages resulting from the use of its products, including financial losses, material or personal damages, business interruptions, or loss of profits.

Client Responsibility:

The Client is responsible for ensuring appropriate conditions at the delivery and assembly site, including access, dimensions, and safety. NZURY cannot be held liable for delays or impossibility of delivery/assembly due to inadequate site conditions.

Custom Products:

All pieces are custom-made. NZURY is not liable for variations in color, texture, or natural wood grain, which are inherent characteristics of the material.

6. Force Majeure

NZURY is not responsible for failure or delay in fulfilling obligations due to events beyond its reasonable control, including strikes, natural disasters, pandemics, supplier failures, or transport company disruptions.

7. Consumer Dispute Resolution

8. Applicable Law and Jurisdiction

Portuguese law applies. For legal disputes, the competent court is the Porto district court, except where consumer protection law dictates otherwise.

9. Language

The reference language is Portuguese.

10. Personal Data Protection

NZURY by J. Pinto Leitão is the entity responsible for processing personal data provided by the Client for the execution of the purchase contract, in accordance with Regulation (EU) 2016/679 (GDPR).

The collected data (name, address, phone contact, email, tax number, and payment details) are processed for:

  • Order processing and management;
  • Invoice issuance and legal/tax compliance;
  • Communication with the Client regarding production and delivery;
  • Warranty registration and management.

 

Data may be shared with third parties when necessary for the above purposes (e.g., accounting firms, transport companies, service providers), ensuring confidentiality and security.

Data will be stored only for the necessary period or for legally required timeframes.

The Client has the right to:

  • Access, rectify, and erase their data;
  • Restrict or oppose processing;
  • Data portability;
  • Withdraw consent (when applicable);
  • Submit a complaint to the CNPD (www.cnpd.pt).
